Proposed Changes to Missouri State Plan Part B

The  Department of Elementary and Secondary Education will hold public hearings regarding the State regulations for special education as required for Part B of the Individuals with Disabilities Education Act (IDEA). The purpose of the hearing is to receive comments from persons interested in special education services for children ages 5K to 21. Public hearings are scheduled for the following dates and locations from 4:00pm-6:00pm

Copies of the proposed changes to the regulations for Part B of the Individuals with Disabilities Education Act (IDEA) will be available for review during regular office hours in the Office of the Assistant Commissioner, Department of Elementary and Secondary Education, 205 Jefferson Street, Jefferson Building, 4th floor, Jefferson City, MO. The proposed changes are also available on the Division of Special Education website at: http://dese.mo.gov/divspeced/PublicHearing05/index.html.  

 

Deletions appear in red text, and additions appear in blue text.

 

Written comments regarding the State regulations may be submitted to the Coordinator, Special Education Services, Department of Elementary and Secondary Education, P.O. Box 480, Jefferson City, MO. 65102-0480 or via email at idea.comments@dese.mo.gov by close of business on Februrary 27, 2007.

 

Following the comment period, the State regulations will be submitted to the Office of Special Education Programs of the U.S. Department of Education and the Missouri State Board of Education for final approval

IDEA 2004 FINAL REGULATIONS and MODEL FORMS

Final Regulations
On August 3, 2006, the U.S. Department of Education has announced the final Part B regulations to implement the Individuals with Disabilities Education Improvement Act of 2004 (IDEA). On August 14, 2006, the official copy of the final Part B regulations of the IDEA was published in the Federal Register.

Model Forms
As part of the 2004 reauthorization of the IDEA, Congress included a requirement that:

"Not later than the date that the Secretary publishes final regulations under this title, to implement amendments made by the Individuals with Disabilities Education Improvement Act of 2004, the Secretary shall publish and disseminate widely to states, local educational agencies, and parent and community training and information centers."

2005 PROCEDURAL SAFEGUARDS

On July 1, 2005, the Division posted a revised copy of the Procedural Safeguards Statement for Children and Parents.  The date on this copy is July 2005.  This document can be accessed on the division website at http://dese.mo.gov/divspeced/Compliance/Proc_Safe/index.html. Agencies should discard any copies of the old Procedural Safeguards Statement (August, 2001) and begin using this new copy immediately.  In mid to late August, the Division will be providing each responsible public agency with copies of the new Procedural Safeguards equivalent to the number of students reported on the agency’s December 1, 2004, child count.  When these are received, the agency should distribute these copies to each child with a disability in their district.  Districts are reminded that there are new requirements regarding the provision of the Procedural Safeguards.  Those requirements are:

• At least one time annually for identified children

• Upon initial referral or parental request for evaluation

• Upon parent request for a copy of the Procedural Safeguards

• Upon certain disciplinary actions

• On the first occurrence of the filing of a due process complaint (will be provided by DESE)

IDEA 2004 FACT SHEETS

The U.S. Department of Education, Office of Special Education Programs (OSEP), has identified several topics where IDEA 2004 is significantly different from the previous IDEA law.  These changes are effective July 1, 2005, except for provisions dealing with Highly Qualified Personnel, which were effective immediately.  The Federal government is likely to complete regulations to implement IDEA 2004 in 2005.  Many states have additional laws and rules based on the 1997 IDEA law.  Many of these state laws and rules now exceed the minimum requirements of IDEA 2004.  Visitors are also encouraged to review the education laws and rules from their states, which affect students with disabilities.

RTI and LD

A report prepared by the National Joint Committee on Learning Disabilities representing eleven national and international organizations June 2005

The purpose of this National Joint Committee on Learning Disabilities (NJCLD) report is to examine the concepts, potential benefits, practical issues, and unanswered questions associated with responsiveness to intervention (RTI) and learning disabilities (LD). A brief overview of the approach is provided, including attributes, characteristics, and promising features, as well as issues, concerns, unanswered questions, and research needs. Issues related to RTI implementation, including use as an eligibility mechanism, parent participation, structure and components, professional roles and competencies, and needed research, are addressed. The report is neither a position paper nor a "how-to guide" for implementing an RTI approach.
